Terms and conditions

1. General
1.1 These general conditions apply to all offers of Merchandise&Entertainment. The conditions are accessible to everyone and included on the web site of Merchandise&Entertainment. On request we will send you a written copy.

1.2 By placing an order you acknowledge that you have with the delivery and payment agreement. Merchandise&Entertainment reserves the right to change its terms and / or conditions after the expiry of the term change.

1.3 Merchandise&Entertainment guarantees that the delivered product meets the contract and meets the specifications listed in the offer.

2. Delivery
2.1 Delivery takes place while stocks last.
2.2 The delivery time is 1-2 working days in most cases. Merchandise & Entertainment, a delivery of up to 30 days. If the agreed delivery for whatever reason is exceeded, the purchaser has the right to terminate the agreement and any payments made within 14 days to the buyer.

3. Price

4. Review period / right of withdrawal
4.1 If there is a consumer, in accordance with the Law on Distance sales (Article 7:5 of the Civil Code), the buyer has the right (a part of) the goods within a period of 14 working days without giving a reason to return. This period begins when the ordered goods are delivered. If the customer after expiration of this period the delivered goods to Merchandise & Entertainment has returned, the purchase is a fact. The customer is obliged, before proceeding to return accordingly within the period of 14 days after delivery to notify in writing Merchandise & Entertainment. The customer must prove that the goods delivered are returned on time, for example by means of a proof of mail delivery. Return of the goods must be in original packaging (including accessories and documentation) and in new condition. If the goods to the buyer have been used, encumbered or in any way damaged, the right of rescission within the meaning of this paragraph. Subject to the provisions in the preceding sentence, Merchandise & Entertainment ensure that within 30 days after receipt of the return, the full purchase price including the shipping to the customer will be refunded. The return of the goods delivered is the sole responsibility and risk of the buyer.

5. Data management
5.1 If you place an order with Merchandise & Entertainment, your data will be included in the customer base of Merchandise & Entertainment. Merchandise & Entertainment adheres to the Data Protection Act and will not provide your information to third parties.
5.2 Merchandise&Entertainment respects the privacy of the users of the web site and shall ensure the confidentiality of your personal data.
5.3 Merchandise&Entertainment sometimes makes use of a mailing list. Each mailing contains instructions to protect yourself from this list.

6. Warranty
6.1 Merchandise&Entertainment guarantees that the delivered products meet the requirements of usability, reliability and longevity as parties to the contract are reasonably designed, and therefore is responsible for the warranty of the product supplied to you.

7. Offers
7.1 All offers are without obligation, unless otherwise stated in the tender.
7.2 Upon acceptance of an offer without copper, Merchandise&Entertainment reserves the right to offer within 3 working days of receipt of such acceptance to revoke or to deviate.

7.3 Verbal agreements Merchandise & Entertainment only after they have been expressly confirmed in writing.

8. Agreement
8.1 An agreement between Merchandise&Entertainment and a customer is established after an order commissioned by Merchandise&Entertainment on feasibility is assessed.
8.2 Merchandise&Entertainment reserves the right, without giving any reason not to accept orders or contracts or only to accept the condition that the consignment under reimbursement or payment.

9. Pictures and specifications
9.1 All illustrations, photographs, drawings, etc., including information on weights, dimensions, colors, images of labels, etc. on the Internet sites of Merchandise & Entertainment are approximate only, are indicative and may not lead to damages or rescission of the contract.

10. Odds
10.1 Merchandise&Entertainment is not liable if and to the extent that she can not be fulfilled due to force majeure.

In no event shall Merchandise & Entertainment account any penalty or damages.

11. Applicable law / jurisdiction
11.1 All agreements are subject to Dutch law.
11.2 Disputes arising from an agreement between Merchandise & Entertainment and copper, which in concert can be resolved, the competent court within the district Zwolle knowledge unless Merchandise&Entertainment prefers to give the difference to the competent court of the domicile of the purchaser, with the exception of those disputes that fall under the jurisdiction of a magistrate.
